Catch 22

For the judges that declared the Pledge of Allegiance unconstitutional, were they themselves out of order?

"So, your Honor, the Pledge is unconstitutional because it says 'Under God'. Wouldn't that mean that when you were sworn in with your hand on a Bible, and at the end of your oath, you repeated, 'So Help Me God'; doesn't that make your job unconstitutional?"

Therefore, you are not legally holding your job; in fact, you have no job and your ruling doesn't mean anything whatsoever!
